Report from the Commission to the European Parliament and to the Council: The memory of the crimes committed by totalitarian regimes in Europe, 22 December 2010. This report was requested of the Commission to answer the question “whether an additional instrument is needed, to cover publicly condoning, denying or grossly trivializing crimes of genocide, crimes against humanity and war crimes directed against a group of persons defined by other criteria that race, colour, religion, descent or national or ethnic origin such as social status or political convictions.” (see below under the section on the Council of the EU)

In which, on March 25 2007, the Council “invites the Commission to examine and to report to the Council within two years after the entry into force of the Framework Decision [(2008/913/JHA), which came into force on 28 November 2008 and subsequently on which the EC must present their report by the 28 November 2010], whether an additional instrument is needed, to cover publicly condoning, denying or grossly trivializing crimes of genocide, crimes against humanity and war crimes directed against a group of persons defined by other criteria that race, colour, religion, descent or national or ethnic origin such as social status or political convictions.”
